Please review this Privacy Policy very carefully. By accessing our website, you are agreeing to this and are expressing that you have been given reasonable access to review this Policy prior to your continued use of our Website. This Agreement is binding as of the date you access our Website.

Privacy Policy Purpose. This Policy describes the types of information we may collect from you or that you may provide when you visit the website https://www.mindsetinmovement.fit/ ("Website"), utilize our custom fitness applications, or interact with our services, alongside our practices for collecting, using, maintaining, protecting, and disclosing that information.

  • Through email or newsletter opt-ins, text, or other marketing features you interact with on the Website.

Our policy does not govern any data or information we collect that is gathered offline.  The Company has no control over data or information gathered by any third-party websites or partners we may link to, including affiliates.

Age Requirements. We do not knowingly collect personal information from children under 18 years of age for any reason or in any circumstance. No one under the age of 18 may access, use, create an account, make any purchases, or provide any information through our Website without verified parental consent. 

In the event we are made aware that we unknowingly gathered personal information or data from an individual under the age of 18, we will promptly delete any related data. This information and data is collected when you provide it to us or automatically as you browse our Website. Your information may also be collected from third parties such as our business partners.

Health, Wellness, and Nutrition Data. To design, deliver, and optimize your customized personal training, fitness programming, and nutrition coaching packages, we collect specific physiological and wellness metrics that you voluntarily provide to us. This includes, but is not limited to: body weight, height, body fat percentage, physical body measurements, fitness levels, exercise history, dietary habits, food and beverage logs, caloric/macronutrient intake, and details regarding physical injuries, medical conditions, or health limitations. This data is gathered directly from your input on our Website or synced through our third-party mobile application platform infrastructure (MyPTHub).

 

To develop, adjust, and monitor personalized exercise routines and nutritional strategies tailored to your physical capabilities and health goals, health and wellness data is utilized strictly for service delivery and program optimization, and is never sold or shared with third-party marketing entities.

 

Sources of Information. By engaging with our Website, you have an opportunity to provide us with personal information about you through forms, surveys, etc. 

 

Before you give us information, it is important to pay attention to what information is required and what is optional. By providing us with your information, you agree that it is correct, personal to you (and no one else whose permission has not been given), and complete.

  • Directly from you - for example, when you fill out our initial intake and assessment forms on our Website, participate in live or electronic consultations and discussions with our training personnel, submit correspondence, sign up for a newsletter, contact our Company, submit a form, submit correspondence or inquiries to our Company through the Website, purchase a product, or create an account and complete assessments through our mobile application platform (MyPTHub).

  • From third-parties - for example such as data vaults, data shares, and/or social media sites.

  • From our mobile application: Data is collected through our custom-branded mobile application, which utilizes the backend technological infrastructure, data processing, and cloud hosting services of our third-party platform provider, MyPTHub (FitCloud Technology Ltd), to track, deliver, and maintain your custom personal training and nutrition packages.

Website users may also post or submit content (“Submissions”) on the Website including, but not limited to reviews, comments, testimonials, forms, and discussions. However, please keep in mind that your submissions are transmitted to our Website and disseminated to others at your own risk. The Company has no control over how other third parties and users interact with your submissions. Please remember this before posting your submissions on our Website. 

Automated Collection Processes. We use automated data collection technologies — including but not limited to browser cookies, flash cookies, bots and web beacons — to get a better understanding of your online activity and behavior over time and across third-party websites and applications.

Strict Restrictions on the Use and Disclosure of Health Data. Notwithstanding any other provision within this Policy, Mindset in Movement treats your personal health, wellness, and physiological metrics with the highest standard of confidentiality. All sensitive data—including but not limited to body weight, health conditions, dietary restrictions, food logs, and physical limitations—is collected and used solely for the purpose of constructing, monitoring, modifying, and delivering your customized personal training and nutrition packages.  The Company strictly guarantees that your personal health and wellness data will never be sold, rented, leased, licensed, or shared with third-party advertisers, data brokers, or external marketing networks for commercial or promotional purposes. Your health data is accessed exclusively by authorized Company personnel and infrastructure processors as required to execute your specific services.

Limitation of Liability for Third-Party Platform Actions. Because our custom mobile application utilizes the third-party backend infrastructure, software, and cloud hosting services of MyPTHub (FitCloud Technology Ltd), Mindset in Movement does not possess direct operational control over the application's technical architecture, server security, or administrative protocols.

By utilizing our services and mobile application, you expressly acknowledge and agree that Mindset in Movement, alongside its owners, trainers, and affiliates, shall not be held legally liable, responsible, or accountable for any damages, losses, or claims resulting from the actions, omissions, system failures, or security lapses of MyPTHub. This includes, but is not limited to, data breaches, unauthorized third-party access, data leaks, server-side data corruption or loss, platform downtime, or any failure by MyPTHub to adhere to privacy regulations or industry-standard security safeguards. Any data entered into, synced with, or transmitted via the mobile application is done at your own risk, and any legal remedies or disputes arising from an infrastructure-level failure must be pursued exclusively against MyPTHub.

Data Disclosure. We only share your information pursuant to this policy and are dedicated to protecting your privacy. 

 

There may be times when automatically collected information or information you directly provided to us may be shared with third parties and in other instances. Please continue reading so you have a full understanding of how we approach the disclosure of your information.

 

Please note that the Company may disclose non-personally identifiable and aggregate information concerning our users at any time without restriction. 

However, we can disclose personal data to any of the following: 

  • Our affiliates, brand partners, subsidiaries, or other selected partners.

  • To our application infrastructure partners: Specifically, MyPTHub, to the extent necessary to host your account, process your workout and nutrition logs, and maintain the functionality of your digital training package.

Also, we can disclose your personal data in the following circumstances:

  • When the law or legal process requires it.

  • In enforcing our Terms of Use and Terms of Purchase (if applicable).

  • When enforcing or protecting our rights or the rights of third parties.

Application Infrastructure and Third-Party Processing. Mindset in Movement delivers its digital training, coaching, and nutrition packages via a custom-branded mobile application. Please be advised that while this application displays our branding and visual identity, the underlying software, data architecture, database storage, and transmission networks are owned and operated by our third-party technology vendor, MyPTHub (FitCloud Technology Ltd).

 

Any personal data, health limitations, physical metrics, or financial information you submit through the mobile application is securely transmitted to and processed by MyPTHub to facilitate service delivery. This data is handled in strict accordance with our operational directives and MyPTHub's privacy and security protocols.

Opting Out. We strive to provide you with choices regarding the personal information you provide to us. We have established the following mechanisms to grant you control over your data:

  • You are generally able to disable or refuse to accept cookies on your browser. 

  • If you do not want us to share your data with third parties, you can unselect that box from any data sharing options when that process is presented to you.  You may also email us at rhett@mindsetinmovement.fit with the request.

  • If you do not want to receive marketing and advertising emails, including other forms of communication from the Company, you can unselect that box from any data sharing options when that process is presented to you. If you have received an email from us with an unsubscribe option, you may also follow the link and unsubscribe from the marketing material through that process.

  • The Right to Opt-Out of Data Sales or Targeted Advertising: Mindset in Movement does not sell, rent, or lease your personal information or sensitive health logs to third parties for monetary or valuable consideration. However, you maintain the absolute right to opt out of any potential future profiling or targeted internet-based advertising tracking protocols.

  • The Right to Non-Discrimination: We strictly prohibit any discriminatory actions, price increases, or service denials against you for exercising your consumer privacy rights.

If we decline to take action on a consumer privacy request, you have the right to appeal our decision within thirty (30) days by contacting us at the same email address. If your appeal is denied, you may contact your state's Attorney General.

International Users & Global Privacy Disclosures (GDPR, UK GDPR, & PIPEDA). If you reside within the European Union (EU), the European Economic Area (EEA), the United Kingdom (UK), or Canada (subject to PIPEDA), your data protection rights are governed by strict international frameworks regarding personal information and "Special Category" sensitive health data.

  • Roles and Infrastructure Architecture. For standard personal data (such as contact and billing details), Mindset in Movement serves as the "Data Controller." For metrics, exercise tracking, and nutritional logging processed directly within our mobile application, our third-party infrastructure provider, MyPTHub (FitCloud Technology Ltd), acts as the "Data Processor" operating under our explicit directives.

  • Lawful Bases for Processing Data. We process your international personal data under the following strict lawful bases:

    • Contractual Necessity: To execute transactions, manage your user account, and deliver your purchased training and nutrition packages.

    • Legitimate Interests: To maintain website security, optimize our services, and defend our legal rights.

    • Explicit, Opt-In Consent: We process your sensitive health metrics, body weight tracking, injury disclosures, and nutritional logs solely on the basis of your explicit, affirmative consent. You grant this consent voluntarily by inputting these details into our platform, and you maintain the right to withdraw this consent at any time.

  • International Cross-Border Data Transfers. Mindset in Movement is operated in the United States, and our web infrastructure is hosted through Wix, Inc. (USA). If you are accessing our services internationally, your data will be transferred to, stored, and processed within the United States and other global cloud servers utilized by our technical infrastructure partners. By interacting with our Website or mobile application, you acknowledge and consent to these cross-border data transfers.

  • Your International Data Subject Rights. Under global data protection laws, you possess the following explicit rights:

    • The right to request a comprehensive copy of your personal data and information.

    • The right to rectify, update, or complete inaccurate information.

    • The right to demand the total erasure of your data ("The Right to be Forgotten").

Data Security, Technical Infrastructure, and Safeguards. Mindset in Movement utilizes established, third-party enterprise technology platforms to deliver our services and protect your personal data.

  • Web-Based Security (Wix): Our official Website (https://www.mindsetinmovement.fit/) is hosted, engineered, and maintained through the Wix platform. All web-based technical safeguards, server-side protections, Secure Sockets Layer (SSL) data encryption protocols during transmission, and firewall management are executed directly through Wix’s security infrastructure. 

  • Mobile Application Security (MyPTHub): All mobile-based data processing, activity tracking, client-facing features, and sensitive health or nutrition database logs are deployed through our custom-branded application, which operates entirely upon the technical architecture and secure cloud hosting networks of MyPTHub (FitCloud Technology Ltd). 

While we ensure that our operational accounts within these platforms utilize strict access controls, please note that no digital data transmission over the internet or cloud storage network can be guaranteed as completely absolute or infallible. Consequently, any data you transmit to us via our website or mobile application is done at your own risk.

Limitation of Liability for Platform-Level Security Incidents. Because Mindset in Movement does not possess direct administrative, proprietary, or operational control over the underlying server architectures or software codebases of Wix or MyPTHub, the Company cannot prevent or mitigate system-level technological vulnerabilities.  By utilizing our Website, purchasing our custom training packages, or creating an account within our mobile application, you expressly acknowledge and agree that Mindset in Movement, alongside its owners, trainers, employees, and affiliates, shall be completely relieved of liability and shall not be held legally or financially responsible for any damages, losses, or claims arising from a security compromise of these platforms.

 

This absolute limitation of liability explicitly covers, but is not limited to: cloud database breaches, third-party cyberattacks or hacking incidents targeting Wix or MyPTHub servers, unauthorized data exposure or leaks, transmission interceptions, server-side data corruption, or extended platform downtime. In the event of an infrastructure-level security failure or data exposure, you agree that any legal claims, disputes, or demands for remedies must be pursued exclusively against the responsible third-party platform provider (Wix, Inc. or FitCloud Technology Ltd) and not against Mindset in Movement. 

Your Role in Data Security. Maintaining data privacy is a shared responsibility. You are strictly responsible for preserving the confidentiality of your account credentials, including your unique username and password used to access our Website or custom mobile application. Any submission or transmission, whether direct or automated, of your personal data to us is done so at your own risk. Mindset in Movement will never proactively ask for your password via unsecured email. If you have reason to believe that your account security has been compromised, you must immediately notify us at rhett@mindsetinmovement.fit.

Correcting Your Information. If your information has changed or you would simply like to review it, you may access and review your personal information by logging into our Website and visiting your account profile page or submit a change request to the Company by email at rhett@mindsetinmovement.fit. If submitting a change request by email, the Company has the right to take up to 30 business days to complete this request. Please note the Company has the right to refuse to update or delete your personal data if the Company believes such a change would violate any law or legal process or if we have reason to believe the requested change is incorrect.

Data Retention and Minimization. Mindset in Movement adheres to strict data minimization principles mandated by domestic and international privacy frameworks. We are committed to ensuring that your personal information, transactional records, and sensitive wellness metrics are never retained for longer than is structurally necessary to fulfill our service obligations, satisfy legal requirements, or resolve operational disputes.

  • Active Client Data: We maintain your user profile, physical metrics, historical workout logs, nutritional tracking, and communication records on our platforms for the entire duration of your active training and coaching relationship with us.

  • Inactive Account Lifespan: In the event that your training package is cancelled, terminated, or your user profile falls entirely dormant, the Company enforces a strict twenty-four (24) month maximum data retention ceiling. Upon reaching twenty-four (24) consecutive months of total account inactivity, all personal identifiers, physiological metrics, health limitations, food logs, and progress files securely hosted within our web infrastructure (Wix) and mobile database systems (MyPTHub) will be permanently and irreversibly deleted, purged, or completely anonymized.

  • Regulatory Exceptions: Notwithstanding our standard 24-month erasure protocol, certain baseline transactional data—specifically your credit card billing receipts, invoice histories, and executed service contracts—will be securely archived for a longer duration as strictly required to comply with state, federal, or international corporate tax laws and statutory financial auditing obligations.

If you wish to proactively request the immediate erasure of your personal or health data prior to the expiration of this standard 24-month inactivity window, you may exercise your "Right to be Forgotten" by submitting a formal deletion directive via email to rhett@mindsetinmovement.fit.

Changes to this Policy. Changes to our Company’s Privacy Policy are necessary as circumstances and the law change over time. When we update our Privacy Policy, we will clearly post the Last Updated Date at the top of this page. If any material changes are made and we have your valid email address on file, we will send you an email notifying you of the change.

Your continued use of our Website following the posting of non-material changes constitutes acceptance of those changes. Material changes governing the use of previously collected historical data will be subject to your affirmative consent.
